  • What do I do after getting a DUII?

    After being arrested for DUII, you are assigned a court date. It is extremely important that you attend court on the date assigned. You may or may not obtain legal representation. It is not necessary, but it certainly may be helpful. If you are seeking legal representation, we are happy to refer you to experienced DUII attorneys. The court will assign you to participate in an initial evaluation with an Alcohol & Drug Service Specialist (ADSS). The ADSS then makes the referral to a DUII treatment agency. You may also start DUII treatment preemptively before participating in an evaluation with the ADSS. For example, if you decide to choose Oregon Recovery Behavioral Health as your primary Oregon DUII treatment provider, you can contact us and get started in the process. Then, inform your ADSS that you’ve already chosen us as your provider and they will send us your referral.

  • What’s the difference between a DUII diversion and a conviction?

    You may be given the DUII diversion option if this is your first offense. There are many variables that the D.A./court considers if/when offering this option. There is never a guarantee that a DUII diversion will be presented as an option. If you have signed a DUII Diversion agreement, you are agreeing to the terms of the agreement, which requires substance-use counseling /DUII treatment. If you satisfy the terms of the DUII diversion agreement, then the DUII offense may be able to be removed from your record at a later date, assuming you have no new offenses. A DUII conviction is usually assigned when a person obtains multiple DUII’s, has a history of substance abuse legal problems, and/or has a high blood alcohol content at the time of the arrest. When participating in the ADSS evaluation, the ADSS may either mark DUII education or DUII rehabilitation on their referral form. Whatever “recommendation” is made by the ADSS, ultimately, the substance-use assessment, facilitated by the DUII treatment provider, determines the final recommendation. Oregon Health Authority Administrative rules allow the DUII treatment provider to determine the appropriate and final level of care through evidence-based diagnostic and level of care placement tools, such as DSM-5 and ASAM.

  • How long is the DUII treatment requirement?

    Oregon DUII Administrative rules and DMV require that a DUII education and rehabilitation program is a minimum of 90 days in treatment/monitoring, including 90 days of sobriety. The treatment agency may assign a higher level of care, to include intensive outpatient services (IOP), which may include 120 days of DUII treatment. If you are attempting to regain your driving privileges and/or need to, additionally, satisfy DMV requirements, call us today.

  • What if I don’t need DUII treatment and I only want my driver's license back?

    Oregon DUII Oregon Revised Statutes and Oregon Administrative Rules require DUII treatment as part of the DUII process. Remember, not all DUII treatment agencies are the same. They often specialize and different areas, have different requirements, and sometimes not all clinical staff are specifically trained in DUII treatment cases. In order to lawfully be a DUII provider within the state of Oregon, Oregon Health Authority must issue this designation on a provider's letter of approval. Oregon Recovery is a full DUII treatment and resource center.
